Cnn Fertility Clinic To Couple

Sad, but a bit strange on the couples' part to claim that the possibility of this happening was totally outside their realm of thinking. I would have been worried about that from the start, in their shoes.

Ironically not only did the clinic mess up the IVF, they mistakenly called the husband when they were trying to call the wife. :rolleyes:

Couple was smart in how they answered the questions.

How can they be "obligated" to turn over the baby to the "DNA parents" when she has the legal right to kill the baby? Isn't it "hers"?
Now, maybe they want to do that and are saying that they have to, but do they legally? So complicated....

AFAIK, and I have not looked into it too deeply, this is still an area that is being explored in the legal world -- embryos as property, that is. For example, if a couple creates embryos but divorces before they can be implanted, who has the right to say what happens to the embryos? Is the ex-husband required to provide support if he does not want implantation but the wife does? This is the same sort of situation ... when the wrong embryo is implanted, who "owns" it, and can you really "own" another human being? Is an embryo property or a human being? If the woman here had not carried to term, but had instead aborted, could the DNA parents have sued her for damages?

It is a legal nightmare, frankly, and there are plenty of moral conundrums accompanying each of these scenarios.

Wow, great points.

The couple has a legal right to kill the baby now, but doesn't have a legal right to keep the baby after it's born. What if the couple went to teh genetic parents and said, "Look, we either keep the baby or we kill it--it's up to you."
