In the decades since, I believe most if not all countries have recognized the Vatican as its own sovereign state.

Seems to me that cooperating in an act which infringes on the Sovereignty of the Papal state would be an act punishable by excommunication. This was ofen the case in the early and late Middle Ages.

Let us say that the Judge ruled differently...thePope then would be required to show up in Court if he ever came to the U.S.

This would mean that Papa Benedict would probably never come to the U.S. That would be really really stupid and sad.
