Apparently there is. The sequence of events that I am familiar with, in that case, is that she went to a house that wasnt hers,(her husbands) owned by someone she had a restraining order out on and broke into it(or entered without permission, etc). At some point while arguing with her husband she left the house, went to her car, retrieved her gun, and came back in and started waving it at her husband. Her children were also in the room by the husband. She then aimed for her husband across the room, then closed her eyes and fired, nearly hitting him. She had no injuries consistent with having been recently beaten/injured, or evidence that her husband was attacking her(and her children were witness attesting to that, as they were present) Now, assuming my memory of the sequence of events isnt fatally flawed, I can see many reasons why her actions werent good. It doesnt really sound at all like self defense. She went to the house, entered, left, got a gun, came back and fired. plenty of chance to not be there. Didnt really seem to be in any immediate danger(though if she is telling the truth about her husband being an abuser, i can understand her actions to a certain extent. But grabbing a gun and trying to kill your bad husband is not self defense, like it would be if you were being attacked or threatened at the time.) She fired a warning shot. This is counterintuitive, but in any court anywhere, warning shots are not good. Self defense implies imminent danger, and a gun should only ever be used as a last defense. Basically if you are not threatened enough, or have time to take warning shots, or to try and hit a leg instead of torso, then you werent in enough danger to justify using the gun. Which plays into the second part of this, warning shots or "less lethal" shots are still incredibly dangerous. A bullet that doesnt hit the target is very likely to carry on through multiple walls(this goes for pistol, shotgun and most rifle rounds) and potentially kill an innocent, even if you cant see them at the time. And aiming for a wounding shot is still incredibly dangerous and potentially lethal. But it is all about intent and need of use. You can use a gun in a last ditch effort to save your life, not as an intimidation or wounding tool, shooting willy nilly and endangering everyone else around you. It very easily could have been her child, or the neighbor who received the bullet. Or hell, a child a mile away if she was shooting up in the air. But, if it wasnt a warning shot, and she was actually trying to kill her husband, you run into the whole "self defense vs murder" thing. I dont remember seeing much to suggest that it wasnt attempted murder, even if it was murdering a jackarse abuser husband. "Pre emptive strikes" only seem to be ok if it is the government pulling the trigger. Anyways, her stupidly high sentence is a result of florida tacking years or decades onto any sentence if it involved the use of a gun. Same reason Zimmerman could have potentially gotten an insane 30 years in prison if the manslaughter charge stuck. TL;DR, warning shots are bad, dangerous to everyone around, ineffective at actually protecting you, and will almost certainly land you in jail. And Florida is a cesspool. I did think (and hoped actually) that there was more to the story but I'm not about ready to go scouring the internets for "what REALLY went down." My mistake.
