Chestertonian Posted June 5, 2013 Share Posted June 5, 2013 A U.S. district court judge has ruled in favor of 10-year-old Sarah Murnaghan, making her eligible for the donor lung she so desperately needs. Earlier today, her parents filed an injunction to stop Health and Human Services Secretary Kathleen Sebelius from enforcing a policy that prevents children under the age of 12 from qualifying for adult lungs. The Murnaghan family issued the following statement. Also, watch Sarah's excited reaction to the good news in the clip below. Effective immediately, Judge Michael Baylson has granted a 10-day temporary restraining order (TRO), instructing Secretary Sebelius of Health & Human Services (HHS) to direct OPTN to cease application of the under 12 rule as to Sarah. If there is another child in this judicial district in Sarah's circumstance, he will consider and probably grant a TRO for them if presented to him in court. The judge set the preliminary injunction hearing for June 14. For us, this means that for the next 10 days, Sarah's placement in the queue for adult lungs will be based on the severity of her illness, and she will not be penalized for her age. Her current LAS score-the measure used to measure illness-- is a 78.) We are experiencing many emotions: relief, happiness, gratitude and, for the first time in months: hope. We cannot say enough about the global outreach and support we've received on behalf of Sarah- people of all ages and walks of life have reached out to us, prayed for us, and asked how they could help.
