I once discussed this with a canon law professor. Their response was : Yes. Excommunication is a legal punishment, not necessarily an indication of the state of one's soul. Though the act itself might be sinful (and warrant an automatic excommunication), the circumstances and intent behind the action might limit culpability. Everytime someone swears that thier right and someone doubts(I did) and comes to find out the doubter was right they get 20 bucks. I usually donate to some charity.
