franciscanheart Posted March 6, 2013 Share Posted March 6, 2013 Haha, I kinda hope this happens because it would frustrate my friend who had some major beef with O'Brien when he was Archbishop here in Baltimore and I'd love to see him react to O'Brien as pope. I think that makes me a troll.The way I phrased that made it seem as if I am "rooting" for Cardinal E O'Brien to be the next pope. This is not the case. Cardinal E O'Brien is who I was given in that random Cardinal selector -- you know the one where they give you a Cardinal to pray for specifically leading up to and through the conclave. You may actually be somewhat surprised at whom he would and would not excommunicate. Burke is probably the best canon lawyer alive today, considered an absolute genius. He knows the laws inside and out, and his judgements are considered to be not textbook examples, but examples that the textbooks should strive to emulate. What this means on a practical level is that if there is any legitimate ground for someone not to be excommunicated, he would know it, and he would never dare overstep the law. There are rather high hurdles that must be overcome in order to issue an excommunication or interdict ferendae sententiae. I say this not to contradict you, but simply to point out that Burke, probably to a higher degree than any other cardinal, would do things by the book, and the rules themselves tend towards caution in serious cases like these ones. That is not to say that Burke does not feel as strongly about such cases as do we, merely that if there are built-in cautions within canon law, he would never sidestep them.
