False; visiting there is not illegal, it is the spending of money that is illegal. One of the many misunderstandings of the embargo. Now is it possible to visit Cuba without spending money there? That could be challanging. 

 

ICE doesn't bust people for visiting, it is the treasury department that nails them. Most people I know that have gone; spent cash only on everything. From plane tickets down to meals.Made it harder for the treasury department to bust them.

If you are hiding your actions in order to prevent getting "caught" then I think that is a good indicator of illegal activity.

my seminarian friend just went in via mexico and got back into the usa just fine...mainly because customs didn't notice he had two entry stamps into mexico ;)

according to a blog post I found http://ttravelguy.wordpress.com/2011/12/14/how-to-prepare-for-a-trip-to-cuba-part-ii/   you are allowed to buy  food and things there but you are very limited on what you can bring back. (obviously, those fancy schmancy cigars you can't bring back) ;)

The personal consumption importation is sometimes allowed, the list changes every couple of years or so.
