Judge finds NC ‘Choose Life’ plates unconstitutional

A federal judge has ruled it is unconstitutional for North Carolina to issue pro-life license plates unless the state offers similar plates supporting abortion rights.
U.S. District Court Judge James C. Fox ruled on Friday that North Carolina cannot produce or distribute the “Choose Life” plate.
Judge Fox concluded, “The State’s offering of a Choose Life license plate in the absence of a pro-choice plate constitutes viewpoint discrimination in violation of the First Amendment.”

Insane.  So the judge is arguing that he must discriminate against Pro-life license plates -- on the grounds that allowing them would be "discrimination"?  It would only be discrimination if they did not allow the others!

In his 21-page opinion (PDF), U.S. District Court Judge James C. Fox said that the state Legislature’s decision to offer a “Choose Life” license plate while refusing to offer a pro-choice alternative “constitutes viewpoint discrimination in violation of the First Amendment.”
North Carolina began offering the plates in 2011 as one of 79 specialty plates approved by the Republican-controlled legislature and signed by Democratic Gov. Bev Perdue. Fifteen dollars of the extra $25 specialty plate fee went to Carolina Pregnancy Care Fellowship, a private group of “pregnancy care ministries.”
 

 

Lawmakers rejected six abortion rights amendments that would have authorized plates that said “Respect Choice” or “Trust Women. Respect Choice.”

So there is more to the story.  They don't allow Pro-choice plates.  That makes more sense.
