I'm sure he does, but until someone decides to remake canon law, the Church will continue its current practice. Indeed, the obvious solution and the most likely is the law will be altered to reflect current practice.

Or maybe over time it will be seen that in fact our practice of Canon law is a bit lacking in this area, and we will come back into conformance with it. Such a thing isn't unheard of.
