As a result, she now owes the school $45,000 in legal fees. The girl, known only as MS, accused a fellow student of raping her at a party. He plead guilty to a misdemeanor charge to avoid jail time and was allowed to return to school and the basketball team. She continued to cheer for the team during games, but refused to shout the boy's name or clap for him when he shot free throws. When the superintendent discovered what she was doing, she was kicked off the team. She sued the Texas school, arguing that her free speech rights had been violated, but two courts ruled that as a cheerleader she speaks for the school, not herself, and did not have the right to refuse. A federal appeals court upheld the ruling and ordered her to pay court costs for filing a "frivolous" lawsuit. Ice_nine
I lol'd but on a serious note this is one of the most fouled up things I've read in a while. We don't take rape and/or sexual abuse seriously enough in this country (or anywhere in the freakin world. really) and this is just another example. Why do people see murder as something more vicious than rape? I know that murder effects more people (family and friends of the victim, the community at large) but rape is a form of torture that can cause profound psychological problems and the brunt of that is placed solely on the victim rather than dispersed through a great number of people. If I had to choose I would rather have a bullet through my head than to suffer the trauma of a violent sexual attack. And if the church wasn't so adamant about bodily mutilation I would think castration and life imprisonment to the the best punishment, but I'll take life imprisonment alone as a viable alternative. I know I'm just ranting and raving. It gets my blood boiling though that's for sure. Many might say I am overreacting, and that sorta makes me feel like the only "sane" one in the mental ward but grrrr . No crime more disproportionately affects women and children, but who cares about them right? /end rant

dairygirl4u2c
there's almost got to more more to it all. how could someone be found guilty of rape and only get a misdemeanor and no prison? maybe there wasn't as much to that issue, so they thought she was out of line for not cheering, maybe she was the one who caused the sexual issues. i'd be more upset with the principle, and perhaps the lawyer advising her. the principle or who's in charge shouldnt have required her to shout his name, that's ridiculous no matter the situation. i can actually see the girl losing, given she's in a public school, which means she can't claim she's on private property etc, and doesn't have to be on the cheerleading team either. that seems pretty clear to me. and i'm sure it'd be pretty clear in the law too. i dont even know how it went so far as an appeals court. i wonder if the appeals court was just wondering if she should have to pay the school, given it's so obviously not in her favor. but, anyways, the lawyer of hers i might be upset with, and maybe should be somewhat responsible, cause this all does seem pretty clear to me, at least from what i know of free speech rights etc. it's so clear, that it is a frivilous law suit. im not sure how she could legally make such that she doesn't have to shout his name. sometimes life just isn't fair or right. that doesn't man you can sue about it all the time. too litigious of a society anyone?
