A 51-year old off-duty Statetrooper who was "off duty and partying" throws a CN grenade into a tent at a rodeo. No charges are filed, but he is given a paid vacation until the incident blows over. Standard operating procedure. He has, of course, been investigated 7 times before for other problems. By the "internal investigations" department, which invariably keeps its findings hidden from the light of day, but always finds there was "no wrongdoing" on the part of Statetroopers, unless the public outcry is overwhelming. Only then do they throw the offender to the wolves. This guy's actions approved by Detective "Yes, I did pull a gun, because I got hit with snowballs" Baylor. Continuing to "serve" the public to this day.

The last sentence, by the rodeo owners, is priceless: "Shafer and DeMarco said use of tear gas during rodeo events is not permitted, and they would have filed criminal charges against a citizen [emphasis added] who released the gas. [Never against a Statetrooper!] "I can't think that we could punish him any more than HPD can, [at all] but how stupid can an individual be," DeMarco said. "If it was John Q. Public, we would arrest then press the full charges that the law would allow." Yes. Because we should all hold Statetroopers to a lesser standard of basic moral human conduct.

Stern, in your rush to find an offense against humanity in this State Troopers actions you overlooked the mitigating circumstance. It clearly states that he was " Off duty and partying " Now we all know we are allowed certain exceptions during the course of party time and while off duty, being both off duty and partying gives this man carte blanche to act in any way he see's fit. I know next time I feel like launching a potentially deadly, you know them weak lung types with emphysema or asthmatics, projectile into a crowd of innocent revelers I will be certain to be both " off Duty " and " partying " so as not to suffer any legal consequences from my actions. Give the guy a break, he was just blowin' off some steam, err, gas.

Ed, my point was that anyone else, blowing off steam or not, would have been arrested. The rodeo operators said they did not try to have him arrested precisely because he was a Statetrooper: "If it was John Q. Public, we would arrest then press the full charges that the law would allow."

If I'm reading between the lines correctly, I think he was employing sarcastic humor to prove your point, not to dispute it.

Nihil Obstat

I'll make sure I'm just letting off steam next time I want to tear gas a public area then. Apparently it's a solid defense now. :proud:

What you say is true.

I'm sending in my sarcasm meter for recalibration.
